Terms of Service

These terms are the agreement between you and the operator of Atomira. By creating an account, pushing code, or otherwise using Atomira, you accept them. If you do not accept them, do not use the service.

1. Who you are contracting with

Atomira is operated by Atomira Labs, an independent project that is not yet a registered company. While Atomira is in early access it is run by the individual behind Atomira Labs, who is your counterparty under these terms. A registered company will be named here, with its address and company number, before Atomira leaves early access.

2. Early access

Atomira is in early access. It is offered free of charge, features may change or be withdrawn without notice, and there is no uptime commitment or service level agreement. Access is currently invite-only and we may decline or revoke an invitation at our discretion.

Keep your own backups

Early access means data loss is a realistic possibility. A git repository hosted here should never be the only copy of your work — every clone is a full backup, so keep one.

3. Your account

  • You must be at least 16 years old, or the minimum age for consent to data processing in your country if that is lower.
  • Accounts are for individual people. You may create organizations for shared work, but you may not share a single set of personal credentials between people.
  • You are responsible for what happens under your account, including actions taken with personal access tokens you have issued and signatures made by SSH keys you register. Revoke tokens and delete keys you no longer use, and tell us promptly if you believe your account has been compromised.
  • The information you give us — including the reason you give when requesting access — must be accurate.

4. Your code stays yours

You keep every right you already had in the code, text, images, and other material you upload. Publishing on Atomira transfers no ownership to us. We claim no rights to your work beyond the two narrow licences described here.

The licence you grant us. To run the service at all, we need your permission to store your content, copy it between systems for backup and redundancy, and transmit and display it to you and to anyone you have given access. That licence exists solely so we can operate Atomira, lasts only as long as you keep the content on the service, and ends when you delete it. We will not sell your content, use it to train machine learning models, or show it to anyone your repository settings do not already allow.

The licence public repositories grant other users. If you set a repository to public, you grant every other Atomira user the right to view it and to fork it — that is, to make their own copy on Atomira and keep it there. Without this, the fork button would put both you and them in an uncertain legal position, because copying someone's code normally requires their permission.

Forking is not an open-source licence

The right above covers viewing and forking on Atomira, and nothing else. It does not let anyone use, modify, or redistribute your code elsewhere. If you want people to be able to actually use your work, add a LICENSE file — a public repository without one is “all rights reserved”, which is rarely what people intend.

What you promise us. You confirm you have the rights to everything you upload and that publishing it here breaks no law and no agreement you are bound by — including any obligations to an employer, and the terms of any open-source licence you are building on.

5. Acceptable use

Do not use Atomira to:

  • break the law, or store or distribute content that is illegal where you or we are located;
  • infringe someone else's copyright, trademark, patent, trade secret, or privacy;
  • harass, threaten, defame, or impersonate anyone, or post another person's private information without their consent;
  • distribute malware, run phishing or fraud, or operate command-and-control infrastructure for an attack;
  • attack the service itself — probing for vulnerabilities without our written permission, circumventing access controls or rate limits, or deliberately overloading our infrastructure;
  • consume resources in ways unrelated to software development, such as cryptocurrency mining, bulk file distribution, or using repositories as a general storage backend;
  • send unsolicited bulk messages, or scrape the service to build a competing dataset.

Security research is welcome

Exploit code, malware samples, and offensive security tooling are a legitimate part of the field, and hosting them here is fine when the repository makes its purpose clear. The line we draw is use, not subject matter: publish research, do not run attacks.

If you find a vulnerability in Atomira itself, report it to security@atomiralabs.com before disclosing it, and we will not pursue you for good-faith research that respects the rest of this section.

6. Moderation and enforcement

If content or behaviour breaks these terms we may remove or hide the content, restrict features, or suspend or close the account. Where it is reasonable and lawful to do so, we will tell you what happened and why, and you can reply to us at hello@atomiralabs.com to contest it. We may act without prior notice where content is clearly illegal, where there is an active risk to other users or to the service, or where the law requires it.

If you believe material on Atomira infringes your copyright, write to us with enough detail to identify the work and the material in question, and your contact details.

7. Ending the agreement

You may stop using Atomira and delete your account at any time from your account settings. We may close your account for a breach of these terms, or — because this is early access — if we discontinue the service, in which case we will give you as much notice as we reasonably can so you can clone your repositories.

Deleting your account deletes your repositories and the personal data we hold about you. Exactly what that covers, and what it cannot reach once other people have cloned or forked your work, is set out in the Privacy Policy.

8. No warranty

Atomira is provided “as is” and “as available”. To the extent the law allows, we make no warranties of any kind — express or implied — about availability, fitness for a particular purpose, accuracy, or that the service will be uninterrupted, secure, or error-free.

9. Liability

To the extent the law allows, we are not liable for lost profits, lost revenue, lost or corrupted data, or any indirect or consequential loss arising from your use of Atomira. Because the service is currently provided free of charge, our total liability to you is limited accordingly.

Nothing in these terms limits liability that cannot lawfully be limited — including liability for death or personal injury caused by negligence, for fraud, or, if you are a consumer, any statutory rights you have that cannot be excluded by agreement.

10. Changes to these terms

We may update these terms as the service develops. For changes that materially affect your rights we will give notice in the application or by email before they take effect. Continuing to use Atomira after that means you accept the new terms; if you do not, you can delete your account.

11. Governing law

These terms are governed by the law of Slovenia, and disputes go to the courts there. If you are a consumer in the EU, this does not deprive you of the protection of mandatory rules in your own country of residence, and you keep the right to bring proceedings there.
